What is an Uncontested Divorce

An uncontested divorce, also commonly referred to as a “desk divorce” essentially means that both parties are in agreement with getting a divorce and with the terms of the divorce. When a divorce is uncontested, there is no need to appear in Court. The documents are completed by AzPerLegal and filed with the Court. The documents are reviewed by a Judge who will then grant what is called a Divorce Judgment. Once the Divorce Judgment is granted, there is a 31 day appeal period. If, after 31 days, no appeal has been filed with the Court (and because both parties are in agreement with the terms of the divorce, there will be no appeal), a Certificate of Divorce is issued and you are officially divorced. A Certificate of Divorce is required should you wish to remarry in the future.
